Terms & Conditions

Luca Transport
Effective Date: January 1, 2026

By booking or using services from Luca Transport (“Company”, “we”, “our”, or “us”), you agree to the following Terms & Conditions.

Luca Transport provides vehicle transport, goods transportation, and moving services within Canada.

1. Services Provided

Luca Transport provides:

  • Vehicle transport services

  • Goods and freight transportation

  • Residential and commercial moving services

Service availability is subject to scheduling, route availability, and operational conditions.

2. Booking & Payment Terms

  • Clients must provide accurate booking information.

  • Deposits may be required to secure service dates.

  • Full payment terms will be agreed upon prior to service.

  • Late payments may be subject to additional charges.

  • We reserve the right to refuse or cancel service at our discretion.

3. Binding vs. Non-Binding Estimates

A. Binding Estimate

A binding estimate guarantees a fixed total price based on the information provided by the client.

The price will not change unless:

  • The client requests additional services

  • Pickup or delivery details change

  • The client provides inaccurate or incomplete information

B. Non-Binding Estimate

A non-binding estimate is an approximation based on initial details provided.

Final charges may vary depending on:

  • Actual weight or volume

  • Access conditions (stairs, elevators, long carry)

  • Additional services requested

  • Changes in pickup or delivery information

Clients will be informed of adjustments before completion of service where possible.

4. Fuel Surcharge Policy

Due to fluctuations in fuel prices, Luca Transport reserves the right to apply a fuel surcharge if fuel costs increase significantly between booking confirmation and service date.

  • Surcharges may apply if fuel prices increase by more than 5%.

  • The surcharge will be communicated prior to pickup.

  • Fuel surcharges will not exceed a reasonable percentage of the total service cost unless agreed in writing.

5. Client Responsibilities

Clients agree to:

  • Provide accurate pickup and delivery information

  • Disclose contents of shipments when requested

  • Properly pack goods unless professional packing services are purchased

  • Remove personal belongings from vehicles unless agreed otherwise

  • Disclose mechanical issues or pre-existing vehicle damage

Luca Transport is not responsible for damage caused by:

  • Improper packing

  • Undisclosed fragile items

  • Mechanical failure

  • Inaccurate information provided by the client

6. Vehicle Transport Terms

  • Vehicles must be in operable condition unless otherwise agreed in writing.

  • Clients must disclose any mechanical or electrical issues prior to pickup.

  • A pre-transport inspection may be completed at pickup and delivery.

  • Luca Transport is not responsible for personal belongings left inside vehicles.

  • Convertible, modified, lowered, or specialty vehicles are transported at the owner’s risk unless declared and approved in writing prior to pickup.

7. Commercial Carrier Liability

Luca Transport operates as a for-hire motor carrier within Canada.

Unless additional insurance is purchased in writing prior to transport, liability is limited to the lesser of:

  • The amount paid for the specific transport service; or

  • The applicable minimum carrier liability required by Canadian federal or provincial law.

Luca Transport is not liable for:

  • Acts of God (weather, natural disasters)

  • Traffic delays or road closures

  • Mechanical or electrical failures

  • Pre-existing damage

  • Wear and tear, minor scratches, road debris

  • Undisclosed high-value items

  • Personal valuables, jewelry, cash, or negotiable instruments

  • Indirect or consequential damages

  • Loss of profit, loss of use, or business interruption

Total liability shall not exceed the amount paid for the service unless additional insurance was purchased and confirmed in writing prior to pickup.

8. Optional Additional Insurance

Standard carrier liability coverage may not cover full replacement value.

Clients may request additional insurance coverage:

  • Must be requested prior to transport

  • Requires declared value

  • May involve additional fees

  • Must be confirmed in writing

Clients transporting high-value vehicles or goods are strongly encouraged to maintain their own insurance coverage.

9. Inspection & Damage Claims

A condition inspection may be performed at pickup and delivery.

To preserve claim rights:

  • Visible damage must be documented at time of delivery.

  • Concealed damage must be reported in writing within 48 hours of delivery.

  • Claims must include photos and supporting documentation.

Failure to follow reporting procedures may result in denial of claim.

10. High-Value Items

Clients must declare any vehicle or shipment valued over $25,000 CAD prior to transport.

Failure to declare high-value items may result in limitation or denial of claim.

Luca Transport is not liable for undeclared high-value goods.

11. Cancellation Policy

Cancellation fees apply as follows:

  • More than 72 hours before pickup: No charge

  • 24–72 hours before pickup: 25% of total quoted price

  • Less than 24 hours before pickup: 50% of total quoted price

  • Same-day cancellation or refusal at pickup: Up to 75% of total quoted price

Deposits are non-refundable within 24 hours of scheduled pickup.

12. Subcontracting

Luca Transport reserves the right to subcontract services to qualified carriers. All liability limitations remain in full effect.

13. Limitation of Legal Action

Any legal action must be brought within 12 months of the service date and in the province where Luca Transport operates.

14. Governing Law

These Terms & Conditions are governed by the laws of Canada and the applicable province in which services are performed.

15. Changes to Terms

Luca Transport reserves the right to update these Terms & Conditions at any time. Continued use of services constitutes acceptance of the updated Terms.
